End User License Agreement This End-User License Agreement ("EULA") constitutes a valid and binding agreement between BMM Solutions  and you, the person or entity, which makes use of the software provided by BMM Solutions. "Software" means any computer software and associated media, including but limited to printed materials, online or electronic documentation, and Internet-based services provided by BMM Solutions. BMM Solutions reserves the right to modify this EULA at any time by providing such revised EULA to you or by publishing the revised EULA on the BMM Solutions website. The revised EULA shall become effective within thirty (30) days of such publishing or provision to you. Your continued use of the software after expiry of the period of thirty (30) days, shall constitute your acceptance to be bound by the terms and conditions of the revised EULA. BMM Solutions reserves the right to make changes and/or add amendments or addendums to this EULA from time to time. You agree to be legally bound by all terms of this EULA, and any new versions thereof, by installing, copying or otherwise using the software. If you do not agree to all terms of this EULA, do not install, copy or use the software. This EULA applies to downloading, installing and using the software, free of charge. The use of any commercial software and/or paid services which may be offered by BMM Solutions, is subject to the commercial license. 1. GRANT OF LICENSE. BMM Solutions grants you the following rights provided that you comply with all terms and conditions of this EULA: 1.1. Subject to the terms of this Agreement, BMM Solutions hereby grants you a limited, personal, non-commercial, non-exclusive, non-sub licensable, non-assignable, free of charge license to install, use, access, display and run one copy of the software on a single computer, such as a workstation, terminal or other device. 2. RESERVATION OF RIGHTS AND OWNERSHIP. BMM Solutions reserves all rights not expressly granted to you in this EULA. The Software is protected by copyright and other intellectual property laws and treaties. BMM Solutions or its suppliers own the title, copyright, and other intellectual property rights in the software. The software is licensed, not sold. You are not authorized to sell, assign, rent, lease, distribute, export, import, sub-license, act as an intermediary or provider, or otherwise grant rights to third parties with regard to the software or any part thereof. You are only entitled to the limited use of the intellectual property rights granted to you in this EULA. 3. LIMITATIONS ON USE OF THE SOFTWARE. You are not authorized to reverse engineer, decompile, modify, hack or disassemble the software or any part thereof, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation. 4. ADDITIONAL SOFTWARE AND/OR SERVICES. This EULA applies to updates, supplements, add-on components and Internet-based services of the software, that BMM Solutions may provide to you or make available to you, unless other terms are provided along with such update, supplement, add-on component, or Internet-based services. 5. TERMINATION. Without prejudice to any other rights, BMM Solutions may terminate this EULA if you fail to comply with all terms and conditions of this EULA. If this EULA is terminated, you agree to delete the installed software from your computer and destroy any back-up or other copies of the software or part thereof. 6. NO WARRANTY. THERE IS NO WARRANTY FOR THE SOFTWARE, TO THE EXTENT PERMITTED BY APPLICABLE LAW. EXCEPT WHEN OTHERWISE STATED IN WRITING THE COPYRIGHT HOLDER AND/OR OTHER PARTIES PROVIDE THE PROGRAM "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE SOFTWARE IS WITH YOU. SHOULD THE PROGRAM PROVE DEFECTIVE, YOU ASSUME THE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION. 7. LIMITATION OF LIABILITY. IN NO EVENT UNLESS REQUIRED BY APPLICABLE LAW OR AGREED TO IN WRITING WILL ANY COPYRIGHT HOLDER, OR ANY OTHER PARTY WHO MODIFIES AND/OR CONVEYS THE PROGRAM AS PERMITTED ABOVE, BE LIABLE TO YOU FOR DAMAGES, INCLUDING ANY GENERAL, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE PROGRAM (INCLUDING BUT NOT LIMITED TO LOSS OF DATA OR DATA BEING RENDERED INACCURATE OR LOSSES SUSTAINED BY YOU OR THIRD PARTIES OR A FAILURE OF THE PROGRAM TO OPERATE WITH ANY OTHER PROGRAMS), EVEN IF SUCH HOLDER OR OTHER PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. This EULA (including any addendums or amendments to this EULA) is the entire agreement between you and BMM Solutions relating to the software and supersede all prior terms and conditions and/or representations with respect to the software or any other subject matter covered by this EULA. If any provision of this EULA is held to be void, invalid, unenforceable or illegal, the other provisions shall continue in full force and effect. This EULA and the relationship between BMM Solutions and you are governed by the laws of Finland. YOU EXPRESSLY ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT AND UNDERSTAND THE RIGHTS, OBLIGATIONS, TERMS AND CONDITIONS SET FORTH IN THIS EULA.
